Court Fixes Feb 18 For Judgement Over Adamawa Lawmaker’s Suspension

A Yola High Court presided by Justice Ambrose Mammadi has set February 18, 2015 for judgement in a suit filed by the member representing Mubi South, Hon. Abdulrahman Abubakar challenging his suspension by his colleagues.

Abubakar has late last year dragged the Speaker and the Assembly to court as 1st and 2nd respondents respectively over his suspension by the house for three months and the dissolution of the House Committee on Finance which he was chairing.

The state Attorney General was later joint in the suit as 3rd respondent.

In his argument, counsel to Abubakar, Mr Ever Odo, argued that the speaker and house of assembly have no powers to suspend Abubakar for 30 days.

Odo also argued that the objection raised by the 3rd defendant (attorney general) challenging the jurisdiction of the court to entertain the case because it was an in-house matter of the assembly was untenable.

Odo who cited cases to support his argument said the court has the right to intervene in the affairs of the assembly or any other organization if there was a breach of the constitution.
